As a result of your acceptance of these Terms, FERTILYSIS grants you a personal, non-exclusive, non-transferable right to access and use the Website for informational, non-commercial purposes only.

These Terms will be governed by and construed in accordance with the laws of Greece. FERTILYSIS makes no representations that the Website is appropriate or available for use in all locations. If you access the Website from locations outside Greece, you acknowledge and agree that you do so on your own initiative and that you are responsible for compliance with applicable local laws. The software, technology, and other information made available through the Website are subject to Greece export controls, and may also be subject to the import laws of your jurisdiction.

Any controversy or claim arising out of, or relating to, these Terms, or the breach thereof, shall be settled by binding arbitration in accordance with the commercial arbitration rules, and judgment upon the award rendered may be entered in any court having jurisdiction thereof. The arbitration proceedings shall be conducted in Athens, Greece and fall under Jurisdiction of Greek Courts. If your order is cancelled, we will attempt to notify you using the email address you have given us with the order.

b. No Sales to Minors. FERTILYSIS do not sell their Services for or to minors, only to adults, who can purchase with a credit card or other permitted payment method. If you are under eighteen (18) years of age, you may use the Services only with involvement and consent of a parent or legal guardian. c. Payment Methods. We accept various payment methods for Product purchases through our website and email, including Mastercard, Visa, and American Express. We will charge your credit card with the amount of purchase, when you place an order for our Services. FERTILYSIS will not proceed with any Services order, without authorization validation of your purchase from your payment method.

d. Shipping. Our Products will be delivered to you, by a shipping method of our choice and shall be delivered to your shipping address. We cannot fully guarantee the services of any shipping service, and delivery dates and times may fall out of schedule We will, however, make our best to ensure that the Products will be delivered to you, as soon as possible, after you place your order. During busy times, such as holiday terms and periods of inclement weather, there may be additional processing and shipping delays. You agree to not hold FERTILYSIS liable for such shipping issues. Most package carriers have a short time frame in which to initiate claims, so if there is a delay, contact the delivery service immediately to resolve any problems. At our discretion, we may choose to halt, or alter the delivery of an order, even though it is in the hands of a delivery agent or shipping company, for good reason or in cases where fraud is suspected. You agree to pay any additional expenses that may occur under these circumstances. FERTILYSIS will provide refunds for Products purchased through the Service solely in accordance with our Return Policy.

On the other hand, when you send us your sample, you will and must use specific shipping methods that are outlined by International Laws in such instances, details of which will be given to you at the time of your purchase. Our guidelines and suggestions should be seriously taken into account, and you are required and expected to proceed with the shipment of your sample in a proper and legal manner, in order to have your sample tested. In case of non-compliance with the above requirements, we preserve the right to refuse your shipment and cancel your order.

Once you obtain your Tests Results from FERTILYSIS the knowledge is irrevocable. You should not assume that any information we may be able to provide to you, whether now or as FERTILYSIS research advances, will be welcome or positive. You should also understand that as research advances, in order for you to have full knowledge of your sample data results in the context of such advances, you may need to obtain further services from FERTILYSIS or from your physician or other health care provider. You may learn information about yourself that you do not anticipate. This information may evoke strong emotions and has the potential to alter your life and worldview. You may discover things about yourself that trouble you and that you may not have the ability to control or. These outcomes could have social, legal, or economic implications. The laboratory may not be able to process your sample, and the laboratory process may result in errors. The laboratory may not be able to process your sample, if your sample does not contain a sufficient material, or the results from processing do not meet our standards for accuracy. If the initial processing fails for any of these reasons, FERTILYSIS will reprocess the same sample at no charge to you. Even for processing that meets our high standards, a small, unknown fraction of the data generated during the laboratory process may be un-interpretable or incorrect (referred to as "Errors"). As this possibility is known in advance, users are not entitled to refunds where these Errors occur. You should not change your health behaviors solely on the basis of information from FERTILYSIS. Make sure to discuss your Test Results with a physician or other health care provider before you act upon your Test Results or other information that we provide.

The Services are not intended to be used by you for any diagnostic purpose and are not a substitute for professional medical advice. You should always seek the advice of your physician or other health care provider with any questions you may have regarding diagnosis, cure, treatment, mitigation, or prevention of any disease or other medical condition or impairment or the status of your health. FERTILYSIS does not recommend or endorse any specific course of action, resources, tests, physician or other health care providers, drugs, biologics, medical devices or other products, procedures, opinions, or other information that may be mentioned on our website.

Reliance on any information provided by FERTILYSIS, FERTILYSIS employees, others appearing on our website at the invitation of FERTILYSIS, or other visitors to our website is solely at your own risk.

By accessing FERTILYSIS Services, you agree to the following:

a. You understand that information you learn from FERTILYSIS is not designed to diagnose, prevent, or treat any condition or disease or to ascertain the state of your health and that you understand that the FERTILYSIS services are intended for research, informational, and educational purposes only. You acknowledge that FERTILYSIS urges you to seek the advice of your physician or other health care provider if you have questions or concerns arising from your Test Results;

b. You give permission to FERTILYSIS, its contractors, successors and assignees to perform genotyping and other analytical services on the data extracted from your sample and you specifically request FERTILYSIS to disclose the results of analyses performed on your samples to you and to others you specifically authorize;

c. You are eighteen (18) years of age or older if you are providing a sample or accessing your Tests Results, or if you are submitting a sample or accessing Test Results of another person, you represent that you have the right to do so; If you are a resident of a country that considers an older age for adulthood ( such as 21, for example ), you should contact us first, stating that age difference and await for our response;

d. Any sample you provide is of the person, type and place specified in your kit or otherwise by FERTILYSIS; if you are agreeing to these Terms on behalf of a person for whom you have legal authorization, you clearly state and accept that the sample provided will be the sample of that person;

e. When you are in the process of receiving/extracting your sample, in order to ship it to us and have your results, you must be very careful about how you proceed. You will be informed by us, upon completion of your order, on what conditions this should happen, as in certain cases, an authorized person might be needed to help in the procedure. You are required and expected to receive your sample, in a proper and legal manner, in order to have it tested, as FERTILYSIS will retain the right to refuse the sample in case of non-compliance with the guidelines given and cancel your order.

f. If you are a customer outside Greece providing a sample, you confirm that this act is not subject to any export ban or restriction in the country in which you reside;

g. Any sample you provide and all resulting data may be transferred and/or processed outside the country in which you reside;

h. You are not an insurance company or an employer attempting to obtain information about an insured person or an employee;

i. You are aware that some of the information you receive may provoke strong emotion;

j. You take responsibility for all possible consequences resulting from sharing with others your Tests Results and you understand that all your Personal Information will be stored in FERTILYSIS databases and will be processed in accordance with the FERTILYSIS Privacy Policy

k. By ordering our tests or services you acknowledge that the sample collection equipment such as the "fertility kit" box, will arrive at your specified address and be delivered according to your instructions. The sample collection equipment box will not be unmarked or covered in any way with the purpose of hiding its logos, purpose and use. It may clearly show logos, pictures and text in plain view including words such as "fertility", chlamydia etc It is your responsibility to choose the recipient and to specify the arrival address.
